By accessing this website or placing an order, you confirm that you have read and agreed to these Terms.

1. Products Sold by TOMOTE

TOMOTE sells electronically delivered products, including software licences, activation keys, prepaid codes, redemption codes, subscription codes and related digital products.

Each purchase is subject to:

  • These Terms;
  • The description and requirements shown on the relevant product page;
  • Any additional conditions clearly shown before purchase; and
  • The licence terms, account requirements and policies of the relevant manufacturer or service provider.

Where the product page contains a condition that is specific to a particular product, that product-specific condition will apply in addition to these Terms.

2. Product Information and Customer Responsibility

TOMOTE will take reasonable steps to provide accurate product descriptions, supported platforms, licence periods, regional restrictions, account requirements and other important information.

Before placing an order, the customer is responsible for checking that:

  • The correct product, version, quantity and subscription period have been selected;
  • The product supports the customer’s device, operating system and intended use;
  • The customer has an eligible manufacturer account where required;
  • The product is valid for the customer’s country or region; and
  • Any existing subscription can be renewed, extended or combined with the purchased product.

Customers may contact TOMOTE before purchasing when clarification is required.

TOMOTE is not responsible for incompatibility, incorrect selection or account restrictions that were disclosed on the product page or imposed by the manufacturer.

3. Prices, Orders and Payment

Prices are displayed in Malaysian Ringgit unless stated otherwise. The total price, including any applicable tax, processing cost or other charge, will be shown before payment.

Available payment methods are displayed during checkout.

An order is not considered accepted until payment has been successfully received and the order has been confirmed by TOMOTE.

TOMOTE may reject or cancel an order where:

  • The product is unavailable;
  • The price or product information contains a clear error;
  • Payment cannot be verified;
  • The order is suspected to be fraudulent or unauthorized;
  • The customer has provided incomplete or inaccurate information; or
  • Fulfilling the order would breach a manufacturer, distributor or legal requirement.

If TOMOTE cancels a paid order before the digital product is delivered, the amount paid for the cancelled product will be refunded.

Customers who notice an error in an order should contact TOMOTE immediately. TOMOTE will attempt to correct the order where it has not yet been processed or delivered.

4. Digital Delivery

Digital products will normally be delivered to the email address provided during checkout or made available through the customer’s account.

The estimated delivery time is within 14 days after order has been confirmed. Some orders may require manual verification or processing by a manufacturer or distributor.

The customer is responsible for:

  • Providing a valid and accessible email address;
  • Checking the inbox, spam and junk folders;
  • Informing TOMOTE promptly if the delivery email is incorrect; and
  • Keeping the delivery email, invoice and digital code secure.

A digital product is considered delivered when the customer can access it through the email address or customer account provided during the order.

Delivery may be delayed by payment verification, security checks, manufacturer processing, public holidays, technical problems or other circumstances outside TOMOTE’s reasonable control.

5. Activation and Verification Within 60 Days

Unless a different period is clearly stated on the product page, all activation keys, prepaid codes, redemption codes, subscription codes and other digital codes must be redeemed, activated and tested within sixty (60) calendar days from the date of delivery.

Any problem involving an invalid code, duplicate code, incorrect product, regional restriction or activation failure must also be reported to TOMOTE within the same 60-day period.

The customer must provide reasonable information requested by TOMOTE, which may include:

  • The order number;
  • A screenshot or exact wording of the activation error;
  • The email address used for the manufacturer account;
  • The product name and device details; and
  • Information requested by the manufacturer or distributor.

The 60-day period is TOMOTE’s activation, verification and replacement-support period. It does not shorten a longer validity period expressly provided by the manufacturer.

After 60 days, TOMOTE may still provide reasonable assistance where possible. However, TOMOTE cannot guarantee that an unused code can still be investigated, verified, replaced, exchanged or refunded because manufacturer systems, product availability, distributor records, activation methods and eligibility requirements may change over time.

TOMOTE may decline a replacement or refund request submitted after 60 days where the delay prevents TOMOTE, the distributor or the manufacturer from confirming the condition or history of the code.

6. Use and Security of Digital Products

Digital products may only be used according to the manufacturer’s licence terms.

Unless expressly permitted by the manufacturer, customers must not:

  • Resell, reproduce or distribute a digital code;
  • Share a single-user licence with unauthorised persons;
  • Attempt to activate a product in an unsupported country or region;
  • Use false information to obtain regional, educational, nonprofit or promotional pricing; or
  • Use a code for any unlawful or unauthorised purpose.

Once delivered, the customer is responsible for keeping the digital product secure. TOMOTE is not responsible where a code is redeemed, disclosed, copied or misused by the customer or by another person who gained access to the customer’s email, device or account.

Customers should not publish or send the complete code to anyone except TOMOTE or the relevant manufacturer when reasonably required for support.

7. Cancellation, Returns, Refunds and Replacements

Due to the nature of digital products, an order normally cannot be cancelled, returned or refunded after the digital code, licence information or subscription has been delivered.

Refunds will not normally be provided for:

  • Change of mind;
  • Accidental purchase;
  • Purchase of the wrong product, version, quantity or subscription period;
  • Failure to check the stated system or account requirements;
  • Incompatibility that was disclosed before purchase;
  • Failure to redeem or test the product within 60 days;
  • A code that has already been successfully redeemed or activated;
  • Suspension or restriction of the customer’s account caused by the customer’s actions;
  • Loss of the delivery email or code after successful delivery; or
  • Problems caused by the customer’s device, network, account or configuration.

Where TOMOTE supplies the wrong product, an invalid code, a duplicate code or a product materially different from what was ordered, the customer should contact TOMOTE promptly.

After investigation, TOMOTE may provide one or more of the following remedies, depending on the circumstances:

  • Technical assistance;
  • Correction of the order;
  • Replacement with the same product;
  • Replacement with an agreed equivalent product;
  • Store credit; or
  • A full or partial refund.

TOMOTE may require the customer to cooperate with reasonable troubleshooting or manufacturer verification before approving a replacement or refund.

Nothing in these Terms excludes or restricts any consumer right or remedy that cannot lawfully be excluded under Malaysian law.

8. Subscription and Licence Periods

A subscription or licence period may begin:

  • When the product is delivered;
  • When the code is activated;
  • When the manufacturer processes the order; or
  • On another date stated on the product page.

The applicable commencement method is determined by the relevant product and manufacturer.

TOMOTE is not responsible for unused subscription time resulting from delayed activation by the customer where the manufacturer started the subscription before activation.

Automatic renewal will not apply unless it is clearly disclosed and accepted by the customer.

9. Manufacturer and Third-Party Services

Products sold by TOMOTE may be developed, licensed, activated or operated by third-party manufacturers.

Manufacturers may change their software, system requirements, features, activation systems, account policies, licence terms or supported platforms.

TOMOTE is not responsible for a manufacturer discontinuing a product or changing a service after purchase. However, TOMOTE will provide reasonable assistance where a change directly affects a recently purchased product.

Manufacturer names, product names, logos and trademarks belong to their respective owners. Their appearance on this website does not transfer ownership of those marks to TOMOTE.

Links to manufacturer or third-party websites are provided for convenience. TOMOTE does not control and is not responsible for the availability, content, security or privacy practices of third-party websites.

10. Technical Support

TOMOTE provides reasonable assistance relating to order delivery, code validity and basic activation issues.

Unless expressly included in the product description, the purchase price does not include:

  • Computer repair;
  • Operating-system repair;
  • Malware removal;
  • Data recovery;
  • Network troubleshooting;
  • Installation of unrelated software;
  • Manufacturer account recovery; or
  • Extensive remote or onsite technical support.

Additional services may be offered separately and may be subject to additional charges.

11. Website Use and Intellectual Property

The content of tomote.my, including its text, graphics, layout and original materials, belongs to or is licensed to Top Modern Technology.

Customers may view, save or print website content for personal use and for placing or managing an order.

Website content must not be copied, republished, modified, distributed or used commercially without prior written permission from TOMOTE, except where permitted by law.

Customers must not interfere with the website, attempt unauthorised access, introduce malicious software, submit fraudulent orders or use the website for unlawful purposes.

12. Website Availability and Liability

TOMOTE will take reasonable steps to maintain the accuracy and availability of the website but does not guarantee uninterrupted or error-free access.

To the extent permitted by law, TOMOTE will not be responsible for indirect or consequential loss, loss of profit, business interruption, loss of opportunity or loss of data arising from:

  • The customer’s device, account, network or configuration;
  • Unauthorised use of a delivered code;
  • A manufacturer’s platform or service;
  • Third-party websites or services; or
  • Circumstances outside TOMOTE’s reasonable control.

Where TOMOTE is legally responsible for direct loss connected with a product, TOMOTE’s total liability will not exceed the amount paid for the affected product, unless Malaysian law requires otherwise.

Nothing in these Terms excludes liability or statutory rights that cannot lawfully be excluded or limited.

13. Personal Information and Transaction Records

TOMOTE may collect and use customer information to:

  • Process and deliver orders;
  • Verify payments and prevent fraud;
  • Provide customer support;
  • Communicate with manufacturers and distributors where necessary;
  • Maintain accounting and transaction records; and
  • Comply with legal and regulatory requirements.

TOMOTE may securely retain electronic transaction and delivery records for at least three years, or for a longer period where reasonably required for tax, accounting, fraud prevention, dispute resolution or other legal purposes.

Customers are also responsible for retaining their invoices, delivery emails and licence information.

14. Changes to These Terms

TOMOTE may update these Terms when its products, business practices or legal obligations change.

Updated Terms will be published on this website with a revised effective date. Changes will apply to orders placed after the new Terms become effective and will not normally alter the agreed conditions of an order already completed.

If any provision is found to be invalid or unenforceable, the remaining provisions will continue to apply.

15. Governing Law and Contact

These Terms and any purchase made through tomote.my are governed by the laws of Malaysia.

Customers should first contact TOMOTE so that any question, activation problem or dispute can be investigated and resolved.

TOMOTE normally responds within one business day. Response times may be longer during weekends, Malaysian public holidays, periods of high demand or where assistance from a manufacturer or distributor is required.
